Key Factors for Calculating Gratuity in the UAE

Contract Type: In the UAE, employment contracts are limited or unlimited, each with different rules for calculating gratuity.

Last Basic Salary: Gratuity calculations should only include the last basic salary. Bonuses and allowances such as housing, transportation, overtime, and children's education are excluded.

Employment Duration: Employees must have completed at least one year of continuous service to qualify for gratuity.

Continuous Employment: Gratuity should be calculated based on continuous employment. Periods of unpaid absence are not included. Unlimited Contract:

Resignation:

  • Before 1 year: No gratuity.
  • 1-3 years: One-third of 21 days' basic salary per year.

  • After 5 years: Full 21 days' basic salary for the first 5 years, then 30 days' salary per additional year.
