Key Factors for Calculating Gratuity in the UAE

Contract Type: In the UAE, employment contracts are limited or unlimited, each with different rules for calculating gratuity.

Last Basic Salary: Gratuity calculations should only include the last basic salary. Bonuses and allowances such as housing, transportation, overtime, and children's education are excluded.

Employment Duration: Employees must have completed at least one year of continuous service to qualify for gratuity.

Continuous Employment: Gratuity should be calculated based on continuous employment. Periods of unpaid absence are not included. Note that our gratuity calculator assumes continuous service from start to end date. If employment was not continuous, adjustments to the calculated gratuity may be necessary.

There are two types of employment contracts in the UAE: Limited and Unlimited. Here's how gratuity is calculated for each:

Unlimited Contract:


  • Before 1 year: No gratuity.
  • 1-3 years: One-third of 21 days' basic salary per year.
  • 3-5 years: Two-thirds of 21 days' basic salary per year.
  • After 5 years: Full 21 days' basic salary for the first 5 years, then 30 days' salary per additional year.

Termination by Employer:

  • Before 1 year: No gratuity.

  • After 5 years: 21 days' salary for the first 5 years, then 30 days' salary per additional year.

Note: Total gratuity cannot exceed two years' basic salary.

Limited Contract:

  • Less than 1 year: No gratuity.

  • More than 5 years: 21 days' salary for the first 5 years plus 30 days' salary for each additional year.
